Our goal at Modern Inconveniences, LLC is to provide the best service possible and to create a positive outcome for our clients. When working together it is good to have a clear idea of expectations. This policy outlines expectations of both Modern Inconveniences, LLC and our Clients. Return Policy for Service and Education Return Policy for Products Assumptions to this Agreement Include: Modern Inconveniences, LLC will make available to The Client all knowledge, information, and expertise in its possession in performing the services. A designated representative from The Client will be available to meet with Modern Inconveniences, LLC when reasonably required for the purpose of discussing the status of services. Modern Inconveniences, LLC will not disclose to any third party or use other than for the purposes of this agreement any knowledge or information obtained during the development and fulfillment of this agreement. RESPONSIBILITIES Client Responsibilities The Client will be responsible for the following: Bringing all necessary equipment to work with (computer, phone lines, any extra equipment that the client deems necessary) to training sessions. Actively attending & engaging in training provided by Modern Inconveniences, LLC. Completing assignments given by Modern Inconveniences, LLC. Communicating and asking for help or assistance when required. Ensuring that all computers and technology equipment is in good working order. Ensuring that all computers have information and data backed up on a separate backup system. Any hardware or software malfunctions. Modern Inconveniences, LLC Responsibilities Modern Inconveniences, LLC is responsible for the following: Providing training as described in program. Providing an educational experience that will teach The Client the tools required as defined the program. Contract does not include incidentals such as additional equipment or software. The final responsibility of the program and its success rests on The Client. DECISIONS You are responsible for decisions made about your work and your business. I am happy to share my opinions, offer resources, or make referrals; however, it is up to you to decide which, if any, to act upon. If you decide to take a recommendation, it is your choice and you take full responsibility for it. If you decide to work with someone based on my referral, you must know the workings of that relationship will be entirely separate of my relationship with you. ACCESS TO ME IN BETWEEN SCHEDULED APPOINTMENTS I understand that you might you have questions in between our appointments (I would!). You are encouraged to stay in touch with me between sessions via email. My clients know I am most reachable by email, for specific advice, to ask a question, to discuss a problem, or to share a major success. I will make time for these extra emails, provided they are quick, focused email questions. If I am unavailable at the time you email, I will do my best to return your email within 24 hours, although a return email cannot be guaranteed during this time period. If additional time is needed to discuss an issue, we will schedule a call together around this. (Please note that I am not available on Thursdays, Fridays, Saturdays, Sundays or U.S. Federal holidays. If I will be unavailable on any other days due to speaking, traveling or vacation, I will give you due notice so you can plan accordingly.)NONDISCLOSURE OF COACHING MATERIALS Material that I give you in the course of our work together is proprietary, copyrighted and developed specifically for Modern Inconveniences, LLC. You agree that such proprietary material is solely for your own personal use for the purpose of starting, growing or marketing your business or service. Any disclosure to a third party is strictly prohibited. COPYRIGHT OF MATERIALS The materials presented to you in all Modern Inconveniences, LLC coaching programs are ALL copyright-protected. Under no circumstances can the copy in these documents be used or reproduced in whole or part without the express written permission of Rebecca Metz. The absence of a copyright notice on any given page or material should NOT be construed as an absence of copyright. These copyrights have been successfully defended in the past and it is the policy of Rebecca Metz to aggressively defend all intellectual properties. Violation of these copyrights can result in civil litigation, substantial penalties, even criminal prosecution. The FBI has jurisdiction over violations of copyright law in the United States. These marketing materials documents are provided for sample purposes only, not for use. Having said this, I always invite you to model materials I send to you, but please do not copy. LITIGATION As we both enter this business arrangement with the very best of intentions, there is the possibility that one member may become dissatisfied. Modern Inconveniences, LLC will make reasonable actions to accommodate and satisfy you. However there may be a point that all reasonable actions does not satisfy the situation. If formal litigation is a result, litigation will be addressed in the Minnesota court system under Minnesota law. BREAK IN SERVICES If any phase of the assignment is delayed by The Client longer than sixty days, Modern Inconveniences, LLC will bill for work completed to date. If at any point either The Client or Modern Inconveniences, LLC desires to cancel this agreement, both verbal and written notice will be given, and an invoice of unbilled time will be rendered.YOUR COMMENTS At the end of our coaching, I will ask you to write a few comments of our work together, as an evaluation. It helps me to see what you liked about the process, what results you received overall and anything else you’d like to add. I find this extremely valuable and now make it a consistent part of working with each client. I thank you in advance for this. Often, I ask clients if I can use these comments in the form of a client testimonial to share with others who are considering my services and products. You’ll let me know if that’s acceptable.
